2.1 Our Services include online fitness, wellness, prenatal and postnatal programs, yoga classes, personal training, nutrition support, and educational courses (“Programs”).
2.2 Details such as duration, inclusions, fees, and specific conditions of each Program will be provided at the time of booking.
2.3 We may update, reschedule, or modify our Services, offerings, or pricing as needed. Material changes will be communicated in advance where possible.
2.4 Access to class recordings, if provided, is for personal use only—typically for one (1) month from the class date. For recorded courses or self-paced programs, lifetime access may apply as stated at purchase.
3. Booking, Payment & Cancellation
3.1 Full or partial advance payment may be required to secure your booking. All fees are non-refundable unless otherwise specified for a specific Program.
3.2 Refunds or credits, if applicable, will follow the Program’s stated cancellation policy.
3.3 We reserve the right to reschedule or cancel any session (live or recorded) for instructor unavailability or unforeseen circumstances. We will provide notice and offer an alternative session or credit wherever reasonable.
3.4 Program access is personal, non-transferable, and may not be shared, resold, or distributed. Unauthorized sharing may lead to immediate removal without refund.
4. Health, Safety & Personal Responsibility
4.1 You confirm that you are physically and medically fit to participate in the Program you select. You must disclose any medical conditions, injuries, or pregnancy-related concerns that may affect your participation.
4.2 Our Services are for general wellness and fitness purposes and do not replace medical advice, diagnosis, or treatment. Always consult a physician or qualified healthcare provider before beginning any fitness or nutrition program.
4.3 You agree to follow all instructions provided by your trainer, stop immediately if you feel pain or discomfort, and seek professional help if needed.
4.4 You understand that participation in fitness or wellness activities carries inherent risks. By enrolling, you voluntarily assume all such risks and responsibilities for your participation.
4.5 You release Wellness With Kshitija, its instructors, and affiliates from any liability arising from injury, illness, loss, or damage incurred during or after participation—except in cases of proven gross negligence or willful misconduct.
4.6 You are responsible for ensuring a safe environment for your online sessions and for the use of proper equipment and setup at your location.
5. Online Conduct & Technical Requirements
5.1 You are responsible for maintaining a reliable internet connection and functional device for accessing live or recorded sessions.
5.2 You agree not to share login details, meeting links, or recorded content with anyone else.
5.3 Disruptive, inappropriate, or disrespectful conduct during live sessions may result in removal without refund.
5.4 We are not responsible for technical interruptions, software issues, or poor connectivity on your end.
6. Recording, Photography & Consent
6.1 Live online sessions may be audio and/or video recorded for educational, quality, and delivery purposes.
6.2 Recordings are the exclusive property of Wellness With Kshitija. Access is limited to participants enrolled in the respective Program.
6.3 You consent to the limited storage of your image or voice if you appear in recordings. If you prefer not to be visible, you may disable your camera during live sessions.
6.4 We may occasionally use anonymized or non-identifiable footage for promotional or training purposes. We will never disclose your personal identity without explicit written consent.
6.5 You may not record, reproduce, or distribute any session content or materials without our written approval.
7. Intellectual Property
7.1 All content on the Site and within our Services (text, images, videos, training materials, etc.) is owned by Wellness With Kshitija or its licensors.
7.2 You may use this content solely for your personal learning and wellness purposes. You may not copy, modify, publish, distribute, or exploit it commercially without permission.
7.3 By submitting testimonials, photos, or feedback, you grant us a non-exclusive, royalty-free, worldwide license to use them in marketing or educational materials—with respect for your privacy and consent.
8. Privacy & Data Protection

10. Limitation of Liability
To the fullest extent permitted by law, our total liability for any claim arising from your use of our Site or Services shall not exceed the total fees paid by you for the specific Program.
We are not liable for indirect, incidental, consequential, or punitive damages, including data loss, profit loss, or emotional distress.
11. Indemnity
You agree to indemnify and hold harmless Wellness With Kshitija, its instructors, employees, and affiliates from any claims, damages, or expenses arising from your breach of these Terms or improper participation in our Services.
12. Governing Law, Jurisdiction & Dispute Resolution
12.1 These Terms are governed by the laws of India.
12.2 Any dispute shall fall under the exclusive jurisdiction of courts located in *Valsad, Gujarat, India*, regardless of your location.
12.3 We encourage resolving disputes through amicable communication or mediation before pursuing legal action.
12.4 If you reside outside India, you acknowledge and consent that Indian law will govern your use of the Services.
13. Severability & Waiver

14. Entire Agreement
These Terms, together with our Privacy Policy and any Program-specific terms, constitute the entire agreement between you and Wellness With Kshitija and supersede all prior understandings or communications.
